Why it is important to make a will

It is important for you to make a Will whether or not you consider you have many possessions or assets because:-

  1. If you die without a Will English law dictates how your assets property and possessions are divided amongst beneficiaries who you have not selected.  This is unlikely to be the way you would have wished your assets to be distributed.

  2. Unmarried partners and partners who have not registered a civil partnership cannot inherit from each other without a Will so the death of one partner in these circumstances would create serious financial hardship for the survivor.

  3. If you have children a Will is necessary to provide financial security for them if they are under the age of 18 years and if both parents perish before they reach that age.  You can also take the opportunity to appoint guardians for your children in your Will.

  4. A well drawn Will may also reduce the amount of inheritance tax payable on the family wealth.

  5. A Will also needs to be reviewed on a regular basis and particularly if there are any changes in your financial and/or family circumstances.  For example: entering into a marriage or a registered civil partnership will revoke any existing Will.

  6. As many court cases will testify there is no substitute for a professionally drawn Will followed by regular reviews.

Important facts about wills for Turkey Property

Basically you have to distinguish between two types of Turkey property;

  1. Land and buildings
  2. Other property - bank accounts, stocks and shares, motor cars etc.

This is important because in the case of (2) the law of the owner will apply. But in the case of (1) Turkish law will apply even if the owner is a non-Turkish national.

Supposing a UK citizen owns a house, company shares and a motor car in Turkey. When he dies, English law will apply in respect of the shares and motor car but Turkish law will apply to the house. Turkish law is substantially different from English law in this respect because under Turkish law you cannot leave your Turkey property to whoever you want under a will. A certain part of the property will be due to the next of kin of the deceased. This is called the reserved portion. The next of kin cannot be excluded even if the owner leaves a will bequeathing all his property to a third party. The picture is further complicated by the fact that ‘who gets what’ depends upon which next of kin are alive at the time of the owner’s death. For example if the owner’s wife and children survive him, they will inherit the full reserved portion to the exclusion of all other relatives. If there are no children then the brothers, sisters and parents will inherit together with any surviving spouse.

Therefore it is advisable that clients buying property in Turkey have a separate will drawn up in respect of any land or buildings owned in Turkey.
